Website Terms and Conditions of Use Relating
These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Fairy Island Festival ÍVF (“Provider”) website located at the domain name (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.
By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.
E-COMMERCE & PRIVACY
The Website www.fairyislandfestival.com sells festival tickets and other products online. The use of the products bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the festival ticket sold on the Website.
The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information, credit card details and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Credit card details are not kept by the Provider under any circumstances.
The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
ADMISSION & TICKETS
Tickets are only available on-line from our website through Nuticket.
Fairy Island Festival tickets are issued in electronic form as an "E-ticket". The provider does not issue any "physical tickets" . The user can then choose to download and print the ticket, or just show the electronic ticket at the gate of the festival on their device.
Festival E-tickets are personalized and need to be registered with valid name and surname. There will be no admission without a valid ticket. Please check all your tickets on purchase, as mistakes cannot always be rectified.
You may purchase more than one ticket per transaction. You must provide the name and surname of each participant while placing an order. After successfully placing and paying for your order you will be emailed your festival ticket.
If you for some reason are prevented from coming to the festival, you can resell your ticket. But note that it is illegal to sell festival tickets at a higher price than you bought them for. If this ticket(s) is re-sold or transferred for profit or commercial gain, you risk being punished by the Faroese authorities.
If you wish to resell your ticket you have the option to transfer your ticket through your profile on Nuticket. It is not sufficient to just print your ticket and hand it over to someone else, since your name is embedded in the QR code. When you transfer your ticket to someone else through Nuticket, their name will be embedded in the QR code instead, even if your name still is written on the ticket itself. You have to deal with the money transaction yourself, this is not done through Nuticket.
Upon arrival at the festival your E-tickets will only be valid in combination with valid ID / passport. Your ID / Passport must match the name which shows when we scan the QR code. We do not accept written mandate to transfer personalized tickets.
Valid Tickets purchased for the Fairy Island Festival will be replaced at the festival entrance with a festival wristband. Only Visitors with a valid festival wristband are allowed entry and movement in the festival area. Festival wristbands may not be removed, cut, torn or damaged in any way or they cease to be valid. The festival reserves the right to request identity validation by presenting a valid ID to the festival staff upon request.
The Fairy Island Festival may decline or forbid entrance into the Festival to anyone who might in any way endanger the safety of the visitors or cause any kind of problems.
Admission and participation at the festival is at the visitors own risk. The Fairy Island Festival and the Landowner will not be held liable for any loss, injuries or damages sustained at the event including damage, theft or losses to property and motor vehicles, if the cause is due to the negligence of the ticket holder or the unforeseeable actions of other patrons or third parties.
REFUND & RETURN POLICY
Generally tickets are non refundable, but we acknowledge that because of covid-19 there are a lot of uncertainties regarding flights, travel, festivals and so on, therefore we make an exception if you are prevented from coming because of covid-19 realated issues which can be proven.
In case of new restrictions from the Faroese government which prevent the Fairy Island Festival from occurring the given year, all festival tickets, except transaction fees, will be refunded or converted into festival tickets for the next year.
If you are unable to attend the event due to unforeseen circumstances related to covid-19, refund requests will be accepted only after following conditions have been met:
Documents to prove that you are prevented from coming to the Fairy Island Festival because of covid-19 must be sent in to firstname.lastname@example.org together with the rest of the required information. (Canceled flight tickets, receipt from hospital or doctor etc.) The document must be from a legal authority and must be valid.
Requests for refunds must be received within one month before the start of the festival. Your purchased ticket will be canceled immediately upon request. There are no refunds after this deadline for any reason including, but not limited to, illness, travel-related problems or loss of employment.
When requesting a refund for a ticket bought through Nuticket you must contact the event organizers directly: email@example.com
We can only send the refund to the same credit-card the ticket was purchased from.
The full name and ticket details provided in this request must match the details given when the ticket was purchased. If you wish to get a refund from a ticket which has been resold, you need to send in the information of the person you bought the ticket from. He/she will then get the money on their account, and it's then both of your responsibility to make sure that the money ends up with the right person (you).
If you are requesting a refund for a friend’s ticket please include them into a mail with us and have them confirm they want their ticket canceled and refunded.
Please select only the tickets that you would like to refund.
All ticket refunds are subject to the original transaction fee, which will not be refunded.
Some refunds (mostly those outside of European Union) will be subject to additional bank charges. This fee will be deducted from the amount which is refunded to the user, meaning that the user is paying for all the transaction fees in the process of refunding the money. In some cases, depending on the bank, this fee can be fairly high.
The pace and scope of refunded tickets payment depend on the achievement of additional sales of refunded tickets. E-ticket refunds will be processed during July of current year.
Please be patient and contact us only if you didn't receive your refund after end-July. Thanks for your understanding.
In order to process your refund, we will need the following information from you: 1) Name and Surname on the tickets you wish to refund, 2) Ticket number (barcode), 3) Ticket price, 4) Address, 5) City, 6) Bank name, 7) IBAN and 8) Swift / BIC Code.
Please make sure your bank info is correct if the correct banking information is not provided this will delay your payment and possibly incur extra bank fees for returned funds.
UPDATING OF THESE TERMS & CONDITIONS
Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
All Visitors (including minors) give their express consent to be photographed, filmed or recorded as part of the audience. All video, photo and audio materials acquired on festival site is subject to be used in promotional materials for the festival without any limitations of time and space and at the sole discretion of The Fairy Island Festival.
By entering the event and by your presence at the event site, you acknowledge that you may be photographed and recorded as part of such footage and its use in distribution (commercial or otherwise) without any payment.
COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS
Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and is protected by international copyright laws. The Providers reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
LIMITATIONS OF LIABILITY
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.
PRIVACY: CASUAL SURFING
The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
CHOISE OF LAW
This Website is controlled, operated and administered by Provider from its offices within the Faroe Islands. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of Faroese laws and regulations. If the User accesses this Website from locations outside of the Faroe Islands, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Faroe Islands, and the User consents to the jurisdiction of the Faroese High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.
The Fairy Island Festival accepts no responsibility for goods or services purchased from third party traders.
To protect your own safety and those of others. Please act responsibly.
Please use bins and recycling points provided.
The festival takes place in old war ruins from world war II, please respect that these need to be preserved. You are not allowed to stand on the roof, or to harm these buildings in any way. Failure to comply with these rules may get you thrown out of the festival.
The burning of plastics, bedding, tents, furniture is not permitted anywhere on the site and could result in criminal charges being brought against anyone caught doing so.
Pyrotechnics, lasers, smoke machines, strobe lighting and special effects may take place during some performances.
WARNING: Exposure to loud and excessive music may be damaging to your hearing!
The following items are not permitted into the festival area.
Illegal substances – we operate a zero tolerance on drugs/legal highs and entry will be refused for those attempting to enter the event with any
Glass (of any kind)
Fireworks, flares, Chinese lanterns, klaxons, air horns or other similar items capable of making loud noise and any item which may reasonably be considered for use as a weapon.
Motorized vehicles (unless a mobility scooter).
You may be searched on entry to the event site. Any items that may be used in an illegal or offensive manner will be confiscated. No responsibility is given for the return of confiscated items. If you are in possession of illegal substances you may be arrested.
Camping will be made possible only to Visitors with a valid Festival ticket.
Access to the camping area is included in the festival ticket.
Camping is allowed only on the designated camping area.
It is forbidden to set up tents outside of the fenced area of the camp or restricted areas of the Festival Camp.
We ask you to respect the nature and clean up after yourselves. Trash bins and recycling points will be provided for this purpose.
CARAVANS / CAMPERVANS
No motorized vehicles are allowed into the festival or camping area.
If you wish to bring your camper-van, you can park it together with the rest of the cars on the parking area which is approximately 1500 meters away from the festival area.
We do not provide electricity, water or toilets in the parking area.
Each person in the camper-van must have a valid Festival Entry Ticket.
You are allowed to put up an external tent from the campe-van, if there is sufficient space. The parking area is firstly for parking the cars, not for camping, so if we need the space for more cars, then we reserve the right to ask you to pack down your tent, or to move it ourselves.
No trading is permitted from caravans or camper vans.
All litter must be cleared from your parking space and put into bins provided or taken home with you.
Security staff patrol the parking area and reserve the right to evict persons from the parking area and the festival itself if they do not adhere to the terms and conditions.
Car Parking will be made possible only to Visitors with a valid Festival ticket.
Vehicles are parked entirely at owners risk.
All car parking is not pre-designated and will be allocated on arrival at our discretion.
PLEASE ABIDE BY THESE RULES!
These Terms and Conditions are to be interpreted in accordance with Faroese law and any dispute arising out of these Terms or their subject matter is subject to the exclusive jurisdiction of Faroese court of law.
